Terms of Service

These Terms of Service (“Terms”) govern your access to and use ofnatekens.com (the “Site”), operated by Nate Ken Studio (“the Studio,” “we,” “us”). By using the Site — including submitting a booking request, project inquiry, or mailing-list signup — you agree to these Terms and to ourPrivacy Policy. If you do not agree, do not use the Site.

1. What the Site is

The Site presents the Studio’s three lines of work — photography, web design & development, and game development — and lets you request services or join an announcements list. The Site itself is informational; it does not process payments, create accounts, or complete transactions.

2. Booking requests and inquiries are not confirmed engagements

  • Submitting a photography booking request, including a preferred date and time, is aninquiry only. Dates and time slots shown in the booking form express your preference — they are not live availability and do not reserve anything.
  • No engagement exists until the Studio confirms it directly with you and, where applicable, both parties sign a separate service agreement covering scope, pricing, deliverables, usage rights, and cancellation terms. That agreement — not these Terms — governs the actual engagement.
  • Web-development inquiries work the same way: budgets and project descriptions submitted through the Site are starting points for a conversation, not binding offers by either party.
  • The Studio may decline any request at its discretion.

3. Eligibility and acceptable use

You must be at least 18 years old (or the age of majority where you live) to submit a booking request or project inquiry. When using the Site you agree not to:

  • Submit false, misleading, or third-party personal information without authorization.
  • Use bots, scripts, or automation to submit forms, scrape content, or probe the Site’s endpoints.
  • Attempt to disrupt, overload, reverse-engineer, or gain unauthorized access to the Site or its infrastructure.
  • Use the Site’s forms to send spam, advertising, or unlawful content.

We may block traffic, discard submissions, or restrict access to protect the Site and its users.

4. Intellectual property

All content on the Site — photographs, text, design, code, motion work, logos, and the Nate Ken Studio name — is owned by the Studio or its licensors and is protected by copyright and other intellectual-property laws. You may view and share links to the Site, but you may not copy, reproduce, redistribute, or use its content commercially without prior written permission. Photography displayed on the Site may not be downloaded, republished, or used in any way without a license from the Studio.

5. Demonstration brands are fictional

The web-design showcase on the Site includes sample brand concepts (for example, fictional restaurant, gaming, real-estate, insurance, and yacht-club sites). These aredesign demonstrations created by the Studio. They are not real businesses, do not represent affiliations or endorsements, and any resemblance to actual businesses is coincidental and unintended.

6. Third-party services and links

The Site uses third-party infrastructure (hosting, email delivery, map data from OpenStreetMap contributors, and font/image CDNs) and may link to external sites and profiles. Those services have their own terms, and the Studio is not responsible for their content or practices.

7. Disclaimers

The Site is provided “as is” and “as available” without warranties of any kind, express or implied, including fitness for a particular purpose, non-infringement, or uninterrupted availability. Content on the Site (including pricing hints, availability, and portfolio examples) is informational and may change at any time without notice.

8. Limitation of liability

To the maximum extent permitted by law, the Studio will not be liable for any indirect, incidental, special, consequential, or punitive damages — including lost profits, lost opportunities, or missed dates — arising from your use of, or inability to use, the Site. The Studio’s total liability arising out of use of the Site will not exceed one hundred U.S. dollars (US $100). Liability arising from a confirmed photography or development engagement is governed exclusively by that engagement’s separate written agreement. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

9. Indemnification

You agree to indemnify and hold the Studio harmless from claims, damages, and expenses (including reasonable legal fees) arising from your misuse of the Site or violation of these Terms.

10. Governing law

These Terms, and any dispute arising out of or relating to the Site, are governed by the laws of the State of Florida and applicable United States federal law, without regard to conflict-of-law rules. Any such dispute will be resolved exclusively in the state or federal courts located in Florida, and you consent to their jurisdiction and venue. These Terms are provided for a Florida-based business; they are a professional working draft and have not been reviewed by an attorney — nothing here is legal advice.

11. Changes, severability, and termination

We may update these Terms or change, suspend, or discontinue any part of the Site at any time. The “Last updated” date reflects the current version. Continued use of the Site after changes take effect constitutes acceptance. If any provision of these Terms is found unenforceable, the remaining provisions stay in full force. These Terms and the Privacy Policy are the entire agreement between you and the Studio regarding use of the Site. Sections 4, 7, 8, 9, and 10 survive any termination of the Site or these Terms.
